At MExplor, we strive to provide safe, personalized, and memorable travel experiences. These Terms and Conditions apply to all users, clients, guests, reservations, services, activities, private stays, and experiences booked directly through MExplor or Mexplor.co.

By accessing our website, requesting information, making a reservation, submitting a payment, or participating in any MExplor service, you confirm that you have read, understood, and accepted these Terms and Conditions.

1. Definitions

For the purposes of these Terms and Conditions, the following definitions apply:

MExplor: The brand offering tourism experiences, activities, retreats, private sessions, camps, and private stays.

User / Client / Guest: Any person who accesses the website, requests information, makes a reservation, completes a payment, or participates in a service.

Services: Activities, experiences, tours, retreats, camps, private sessions, classes, accommodations, and other services offered by MExplor.

Casa MEXPLOR: A private property offered for direct rental by MExplor, subject to specific conditions.

Reservation / Booking: A service confirmed through payment and submission of the corresponding proof of payment.

Provider / Supplier: Any third-party guide, instructor, captain, driver, accommodation provider, tour operator, or service provider that may participate in the delivery of a MExplor experience.

2. Services Offered by MExplor

MExplor offers tourism and recreational services directly or in collaboration with third-party providers. These may include, but are not limited to:

  • Aquatic, cultural, recreational, and wellness activities.
  • Customized retreats and camps.
  • Snorkeling, diving, cenote, beach, and nature experiences.
  • Dance classes, private sessions, and special events.
  • Photography and guided experiences.
  • Private accommodations, including Casa MEXPLOR.

Each service may be subject to additional conditions depending on the type of activity, location, provider, weather, availability, or specific requirements of the experience.

3. Acceptance of Terms

By completing a reservation, payment, or service request, the client accepts these Terms and Conditions, as well as any specific policies communicated before or during the booking process.

The client is responsible for reviewing all information related to the service, including meeting points, schedules, inclusions, exclusions, physical requirements, cancellation policies, and payment deadlines.

4. Reservations and Confirmation

A reservation is considered confirmed only when:

  • The service, date, time, and number of participants have been agreed upon.
  • The required deposit or payment has been made.
  • Proof of payment has been submitted.
  • MExplor has confirmed the reservation.

MExplor reserves the right to reject, modify, or cancel any reservation that does not comply with these Terms and Conditions.

5. Payments and Deposits

Unless otherwise stated, a deposit of 30% of the total service cost is required to confirm a reservation.

For special classes, private events, or customized services, MExplor may require a deposit of up to 50% of the total price to reserve the date.

The remaining balance must be paid no later than 7 days before the scheduled service date, unless a different deadline has been agreed upon in writing.

If the remaining balance is not paid within the required period, MExplor reserves the right to cancel the reservation and retain the deposit as compensation for holding the date.

Payments may be processed through secure payment providers, including Stripe or other authorized platforms.

6. Prices and Currency

Prices may vary depending on season, availability, service characteristics, number of participants, provider rates, location, and customization level.

Prices are generally quoted per person unless otherwise specified.

Exchange rates may vary. When prices are quoted in USD and paid in MXN, the applicable exchange rate will be the rate communicated by MExplor at the time of booking.

Price quotations are subject to change until a reservation has been confirmed through payment.

Unless clearly stated as included, prices do not include:

  • Tips or gratuities.
  • Personal expenses.
  • Transportation not specified in the service description.
  • Food or drinks not listed as included.
  • Park fees, dock fees, access fees, taxes, or local charges.
  • Travel insurance.
  • Passport, visa, immigration, or travel document costs.

7. General Cancellation and Refund Policy

For most MExplor activities, tours, and experiences, the following cancellation policy applies unless a specific service states otherwise:

  • 7 days or more before the service: full refund of the amount paid, including the deposit.
  • 3 to 6 days before the service: 50% refund of the total amount paid.
  • Less than 72 hours before the service: no refund.
  • Same-day cancellations or no-shows: no refund.

Cancellation requests must be sent in writing through MExplor’s official communication channels.

Refunds, when applicable, will be processed through the same payment method used for the reservation whenever possible. Refund processing times may vary depending on the payment provider or bank and may take up to 7 business days after approval.

8. Booking Modifications and Rescheduling

Clients may request changes to the date, time, service, or number of participants at least 4 days / 96 hours before the scheduled service, subject to availability.

Modifications are not guaranteed and depend on provider availability, schedules, weather, logistics, and service type.

For class packages, clients may reschedule one class free of charge if the request is made at least 24 hours before the scheduled class. After that period, the class may be charged as completed.

If the client requests a change of location or meeting point, MExplor will evaluate whether the change is possible. A change of location does not automatically constitute grounds for a refund.

9. Late Cancellations and Force Majeure

Cancellations made less than 72 hours before the scheduled service are not eligible for a refund, except in duly documented cases of force majeure.

Force majeure may include, but is not limited to:

  • Medical emergencies.
  • Flight cancellations or major travel disruptions.
  • Natural disasters.
  • Government restrictions.
  • Severe weather conditions that make the activity unsafe.

MExplor may request supporting documentation before evaluating any refund, credit, or rescheduling option.

The final decision regarding force majeure exceptions remains at the discretion of MExplor and/or the applicable provider.

10. Weather Conditions

Some activities may be affected by weather, sea conditions, wind, rain, visibility, or other natural factors.

If MExplor or the provider determines that conditions are unsafe, the client may be offered the option to reschedule or receive a full or partial refund, depending on the circumstances and provider policy.

Rain, humidity, heat, insects, natural sounds, wildlife, or normal environmental conditions do not automatically constitute grounds for cancellation or refund.

For outdoor and nature-based experiences, clients acknowledge that weather and environmental conditions are part of the experience.

11. Activities Canceled by MExplor or the Provider

If an activity is canceled by MExplor or the provider due to unsafe weather conditions, lack of availability, operational issues, or any other reason beyond the client’s control, the client will be offered one of the following options:

  • Reschedule the activity, subject to availability.
  • Receive a full or partial refund, depending on the service and circumstances.
  • Apply the payment as credit toward another MExplor experience, when available.

MExplor is not responsible for additional expenses incurred by the client, including transportation, accommodation, meals, or personal travel arrangements.

12. No-Shows and Late Arrivals

Clients must arrive at the designated meeting point at least 15 minutes before the scheduled time, unless otherwise instructed.

If the client does not arrive at the meeting point at the confirmed time, the reservation may be considered a no-show.

No-shows are not eligible for refunds, credits, or rescheduling.

Late arrivals may result in reduced activity time, itinerary changes, or cancellation of the service without refund.

13. Client Responsibilities

Clients are responsible for:

  • Arriving on time at the confirmed meeting point.
  • Providing accurate personal and contact information.
  • Reviewing all booking details and instructions.
  • Informing MExplor of any relevant health, physical, medical, or mobility conditions.
  • Following safety instructions from guides, instructors, captains, or staff.
  • Respecting local rules, natural environments, wildlife, and other participants.
  • Bringing appropriate clothing, shoes, identification, and personal items required for the activity.

For water, adventure, wellness, or physical activities, clients must honestly disclose any condition that may affect their safety or participation.

MExplor reserves the right to deny participation if a client’s condition, behavior, intoxication, lack of required documents, or failure to follow instructions creates a safety risk.

14. Minors

Minors must always be accompanied by a responsible adult.

MExplor may request official identification for minors when necessary.

The accompanying adult is fully responsible for the minor’s behavior, safety, and compliance with activity requirements.

15. Insurance

Some excursions may include basic accident coverage depending on the provider and type of activity.

MExplor strongly recommends that all clients purchase comprehensive personal travel insurance before participating in any experience.

Travel insurance may help cover cancellations, medical emergencies, lost items, travel delays, and other unexpected situations.

MExplor is not responsible for expenses that could have been covered by personal travel insurance.

16. Third-Party Providers

Some services may be operated directly by MExplor, while others may be delivered in collaboration with third-party providers, including guides, instructors, drivers, captains, tour operators, accommodations, or wellness professionals.

By booking a service, the client acknowledges that some parts of the experience may be subject to the policies, rules, and conditions of the applicable provider.

MExplor is not responsible for acts, omissions, delays, errors, injuries, damages, losses, or service failures caused by third-party providers, except where required by applicable law.

17. Passports, Visas, and Travel Documents

Clients are responsible for ensuring that they meet all travel, immigration, passport, visa, health, and entry requirements related to their trip.

Requirements may change at any time. Clients should verify all necessary information with the appropriate embassy, consulate, airline, or government authority before traveling.

MExplor is not responsible if a client is denied entry, transportation, participation, or service due to missing, expired, incorrect, or invalid documents.

18. Liability and Assumption of Risk

Participation in MExplor activities is voluntary and may involve inherent risks, especially in outdoor, aquatic, physical, wellness, nature, or adventure-based experiences.

By participating, the client accepts these risks and agrees to follow all safety instructions.

MExplor is not liable for injuries, losses, delays, damages, accidents, weather-related issues, personal decisions, health conditions, third-party actions, or external factors beyond its reasonable control.

Clients are responsible for their personal belongings at all times.

19. Indemnification

The client agrees to hold MExplor, its team, collaborators, representatives, and providers harmless from any claims, damages, expenses, losses, injuries, or liabilities arising from:

  • Breach of these Terms and Conditions.
  • Failure to follow safety instructions.
  • Misrepresentation of health or physical conditions.
  • Negligent or inappropriate behavior.
  • Damage caused to property, nature, equipment, staff, providers, or other participants.
  • Violation of laws, regulations, or third-party rights.

20. Dance Classes, Special Events, and Private Sessions

The following conditions apply to dance classes, private classes, special events, and related services.

Scheduling

Classes must be scheduled at least 24 hours in advance, unless otherwise agreed.

For class packages, each following class may be scheduled at the end of the previous class, subject to instructor availability.

Included Services

Depending on the service booked, classes may include:

  • Instructor guidance.
  • Speaker or music equipment.
  • Access to the teaching methodology according to the selected level.
  • Questions and answers related to the class topic.

Requirements and Recommendations

Participants should bring comfortable clothes and appropriate shoes.

Tennis shoes are recommended. Socks may be allowed depending on the floor and class location.

Participants should avoid taking the class if they have severe injuries or physical conditions that may be aggravated by movement.

Participants must inform the instructor of any relevant requests, limitations, or considerations before the class begins.

Rescheduling and Refunds for Classes

Classes may be rescheduled if the request is made at least 24 hours in advance, subject to availability.

If the client cancels less than 72 hours before the scheduled class, no refund will be issued. MExplor may offer a rescheduling option depending on availability.

If weather or external conditions prevent the class from taking place safely, the class may be postponed to another date.

21. Camp Experiences, Custom Camps, and Retreats

All camp experiences, retreats, and custom camps are organized according to a predefined schedule designed to ensure the proper delivery of services, activities, meals, transportation, and logistics.

Guests must follow the schedules communicated by MExplor, including but not limited to:

  • Meal times.
  • Activity start times.
  • Transportation departures.
  • Meeting points.
  • Check-in or check-out times.
  • Group instructions.

Failure to comply with the established schedule, including delays, absence, or failure to be ready at the designated time, may disrupt the itinerary and affect the delivery of planned activities.

Any modifications, reductions, or cancellations caused by guest delays or non-compliance will not be considered a failure of service by MExplor. No refunds, credits, or compensation will apply in such cases.

Camp packages do not include gratuities or tips unless specifically stated. Tips, service charges, voluntary payments to third-party providers, and personal expenses remain the sole responsibility of the guest.

Participation in a camp, retreat, or custom experience constitutes full acceptance of these conditions.

22. Casa MEXPLOR

The following clauses apply exclusively to the rental of Casa MEXPLOR when booked directly with MExplor and outside third-party platforms.

Casa MEXPLOR offers private stays in a natural environment designed for rest, disconnection, and a conscious experience of the surroundings.

Reservation Confirmation

A Casa MEXPLOR reservation is confirmed only when:

  • The stay dates have been agreed upon.
  • The required payment has been made.
  • Proof of payment has been submitted.
  • MExplor has confirmed the reservation.

Deposits and Payments

The deposit is required to block the dates and is non-refundable.

The remaining balance must be paid at least two weeks before the check-in date, unless another deadline has been agreed upon in writing.

Failure to comply with payment deadlines may result in automatic cancellation of the reservation without refund.

Cancellation Policy for Casa MEXPLOR

  • Cancellations made 15 days or more before check-in: the deposit is non-refundable.
  • Cancellations made less than 15 days before check-in: no refund will be issued.
  • Same-day cancellations or failure to arrive are considered no-shows and are non-refundable.

Late Arrivals

Late arrivals must be communicated in advance.

After 24 hours without notice, the reservation will be considered a no-show.

Early Departures

No refunds will be issued for early departures, changes in personal plans, or guest decisions.

Date Changes

Date changes are subject to availability and approval by Casa MEXPLOR.

Requests must be made in advance.

If the date change is approved, the deposit may be retained and applied to the new dates.

Natural Environment and Weather Conditions

The guest acknowledges and accepts that rain, humidity, heat, local wildlife, insects, natural sounds, and other environmental conditions are part of the experience and do not constitute grounds for cancellation or refund.

Force Majeure

Exceptions may be considered only in duly documented cases of force majeure.

The final decision remains at the discretion of Casa MEXPLOR.

23. Website Use

Users agree to use Mexplor.co lawfully and responsibly.

Users must not engage in fraudulent, abusive, harmful, disruptive, or unauthorized activities that may affect MExplor, its website, operations, providers, clients, or services.

MExplor reserves the right to restrict access, reject requests, cancel reservations, or take appropriate action if a user misuses the website or violates these Terms and Conditions.

24. Modifications to Services

MExplor may modify, suspend, replace, or discontinue any service, activity, itinerary, provider, schedule, inclusion, or feature when necessary due to availability, safety, weather, operational needs, provider changes, legal requirements, or other circumstances.

If a material change affects a confirmed booking, MExplor will make reasonable efforts to offer an alternative, rescheduling option, credit, or refund when applicable.

25. Updates to These Terms

MExplor reserves the right to modify these Terms and Conditions at any time.

Updated versions will be published on Mexplor.co and will take effect upon publication.

By continuing to use the website, request information, make reservations, complete payments, or participate in services after the Terms have been updated, the user accepts the revised version.

26. Governing Law and Jurisdiction

These Terms and Conditions are governed by the applicable laws of Mexico.

Any dispute arising from or related to the use of the website, services, reservations, payments, cancellations, or participation in MExplor experiences shall be submitted to the competent courts of Cancun, Quintana Roo, Mexico, unless applicable law requires otherwise.

28. Final Provisions

These Terms and Conditions constitute the agreement between the client and MExplor regarding the use of the website, booking process, services, and experiences.

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain valid and in effect.

Any rights not expressly granted herein are reserved by MExplor.
